Terms of Service
These Terms explain the rules for using Tickets254 to create events, sell tickets, buy tickets, receive tickets, and use related payment and messaging services.
1. Who we are and what these Terms cover
Tickets254 provides an online event ticketing and event-management platform. Event organizers use the platform to create events, sell or issue tickets, manage attendees, and communicate with customers. Attendees and buyers use the platform to discover events, purchase tickets, and receive ticket information.
These Terms apply when you access the website, create an account, list an event, buy a ticket, receive a ticket, or otherwise use Tickets254 services.
2. Agreement to these Terms
By using Tickets254, you agree to these Terms, the Privacy Policy, and any event-specific terms shown during checkout. If you use the platform on behalf of an organization, you confirm that you are authorised to bind that organization.
We may update these Terms from time to time. The updated version will apply from the date shown on this page, unless a later effective date is stated.
3. Accounts and organizer responsibilities
- You must provide accurate account, organizer, contact, tax, payment, and event information.
- You are responsible for keeping your login credentials secure and for activity on your account.
- Organizers are responsible for the truthfulness of event listings, ticket availability, event admission rules, refund rules, venue rules, age restrictions, licences, permits, taxes, and compliance with applicable Kenyan law.
- Organizers must not use Tickets254 to promote unlawful, misleading, fraudulent, discriminatory, unsafe, or infringing events or content.
4. Event listings and tickets
A ticket is evidence of a right to attend or receive access to an event from the organizer. The organizer remains responsible for delivering the event and for making admission decisions in line with the event terms and applicable law.
Tickets may include names, QR codes, barcodes, order references, and other security features. A ticket may be rejected if it is duplicated, altered, cancelled, refunded, previously scanned, or obtained unlawfully.
5. Prices, fees, taxes, and payment
- Prices, taxes, and fees shown at checkout should be reviewed before payment. The final amount charged may include organizer charges, platform fees, payment processing fees, and applicable taxes.
- Payments may be processed by third-party payment providers, including Paystack, card networks, banks, and mobile money providers. We do not store full card details on our servers.
- Payments may be delayed, declined, reversed, or cancelled by a payment provider, bank, card network, mobile money provider, regulator, or fraud-control process.
- Organizers are responsible for determining and remitting taxes arising from their events unless Tickets254 expressly agrees otherwise in writing.
6. Refunds, cancellations, and postponements
Refund and cancellation rules may be set by each organizer and displayed during checkout or on the event page. Where an organizer cancels, postpones, materially changes, or fails to deliver an event, the organizer is responsible for handling attendee remedies in accordance with its policy and applicable Kenyan law.
Tickets254 may assist with refund processing where technically possible, but payment provider charges, bank charges, platform fees, or already-incurred delivery costs may be non-refundable unless Kenyan law requires otherwise.
Nothing in these Terms removes protections that a consumer has under the Consumer Protection Act, the Sale of Goods Act, or any other applicable Kenyan law.
7. WhatsApp, email, and transactional messages
Tickets254 may send order confirmations, tickets, receipts, event updates, security notices, and support messages by WhatsApp, email, SMS, or other channels you provide. These messages are necessary for ticket delivery and account administration.
Marketing messages require a lawful basis such as consent or another basis allowed by law. You can unsubscribe from optional marketing where an unsubscribe mechanism is provided.
8. Acceptable use
- Do not access, interfere with, reverse engineer, overload, scrape, or bypass security controls on the platform without written permission.
- Do not upload malware, unlawful content, misleading content, forged tickets, or content that infringes another person's rights.
- Do not use the platform to commit fraud, identity theft, unauthorised access, cyber harassment, or any offence under the Computer Misuse and Cybercrimes Act.
- Do not resell tickets in breach of event rules, platform rules, or applicable law.
9. Intellectual property and content
Tickets254 software, branding, design, and platform content belong to Tickets254 or its licensors. You may not copy or reuse them except as allowed by law or by written permission.
Organizers retain rights in the event content they upload. By uploading content, you give Tickets254 a licence to host, process, display, resize, transmit, and use that content as needed to operate, market, secure, and support the platform and the relevant event.
10. Availability and changes to the service
We aim to keep Tickets254 reliable, but we do not guarantee uninterrupted access. Maintenance, outages, hosting issues, payment-provider issues, messaging-provider issues, internet failures, force majeure events, or security incidents may affect availability.
We may change, suspend, or discontinue features where needed for security, legal compliance, product improvement, or operational reasons.
11. Suspension and termination
We may suspend or terminate access, remove event listings, cancel orders, withhold payouts, or refuse service where we reasonably believe there is fraud, unlawful activity, security risk, breach of these Terms, regulatory risk, or harm to attendees, organizers, Tickets254, or third parties.
12. Liability
To the maximum extent permitted by Kenyan law, Tickets254 is not liable for indirect loss, loss of profit, loss of opportunity, loss of goodwill, event cancellation losses, venue failures, organizer failures, attendee conduct, or third-party provider failures.
Where liability cannot be excluded, our liability is limited to the amount you paid directly to Tickets254 for the affected transaction or service, unless Kenyan law requires a different remedy.
Nothing in these Terms excludes liability for fraud, wilful misconduct, gross negligence, or any liability that cannot be excluded under Kenyan law.
13. Governing law and disputes
These Terms are governed by the laws of Kenya. The parties will first try to resolve disputes in good faith through support or direct communication. If a dispute is not resolved, the courts of Kenya will have jurisdiction, unless another dispute forum is required by applicable law.
